    Committee briefing

    The committee reviews a feasibility pack: structural capacity, indicative proceeds, proposed use of funds and the delivery program. No vote is required to investigate.

    Independent advice

    Owners corporations typically obtain a valuation of the airspace, a structural engineer's opinion and strata legal advice on the dealing before a motion is drafted.

  3. 03

    Motion and meeting notice

    The motion, draft contract and plan of subdivision are circulated with the general meeting notice within the notice period set by the relevant state legislation.

  4. 04

    The resolution

    Adding lots to common property airspace is a dealing with common property, so it needs a higher threshold than an ordinary motion — a special resolution in NSW, and in most cases unanimous or special resolution equivalents in Victoria and Queensland depending on the structure used.

    Registration and delivery

    Subdivision and by-law changes are registered, the development consent is issued, then fabrication starts off-site and placement happens in a single crane window.

Owners Corporations Act 2006 and Subdivision Act 1988 — resolution thresholds depend on whether common property is sold or leased; plan of subdivision lodged with Land Use Victoria.
QLD
Body Corporate and Community Management Act 1997 — resolution without dissent is commonly required to dispose of common property; new community management statement recorded with Titles Queensland.
